What Types Of Cases Are Heard In Municipal Court?

At the lowest level of our justice system or local level or town level, we have what is referred to as "Municipal Court" or "Town Court". Above the Municipal Court is the Superior Court of New Jersey, which handles a variety of different types of matters ranging from personal injury cases to divorce and criminal matters. Above the Superior Court is the Appellate Division, which sits in review of the Courts below. Above the Appellate Division, we have the Supreme Court of New Jersey, and above the Supreme Court of New Jersey is the United States Supreme Court located in Washington, D.C.

Cases handled in Municipal Court include:

• Violations of motor vehicle and traffic laws;
• Violation of fish and game laws;
• Violations of Municipal Ordinances or local town ordinances or local town laws;
• Disorderly persons' offenses (e.g. offenses against a person would include a simple assault or perhaps a fight, criminal mischief or criminal trespass, domestic violence and/or underage drinking;
• Petty disorderly persons' offenses and other non-indictable offenses;
• Violations of the laws regarding boating.

Penalties in Municipal Court depends upon the offense itself - motor vehicle violations to disorderly persons' offenses, if you are found guilty or plead guilty to an offense, a Municipal Court Judge has the authority to enter fines, costs and other penalties, including jail time, community service and license suspensions.
